Overview

An International Trademark Registration allows businesses to protect their brand identity in multiple countries through a single application under the Madrid Protocol system, administered by the World Intellectual Property Organization (WIPO).

Instead of filing separate trademark applications in each country, applicants can file one international application designating several member countries, saving time, cost, and effort while ensuring global brand protection.

Important Notice

All trademark assignments must be filed within six months from the date of execution as per Rule 75(1) of the Trade Marks Rules, 2017. Late filing requires justification and Registrar approval.

What is International Trademark Registration?

International Trademark Registration enables brand owners to protect their trademarks in multiple countries using a single application through WIPO under the Madrid Protocol.

It simplifies the process by allowing applicants to manage renewals, changes, and ownership updates centrally through WIPO instead of individual national offices.

The system currently includes over 110 member countries, including India, the USA, the UK, and the European Union.

Benefits of International Trademark Registration

Simplified Global Protection

One application covers multiple countries.

Cost Efficiency

Avoids multiple national filings, translations, and legal fees.

Centralized Management

Handle renewals, ownership changes, or updates via one system.

Global Brand Recognition

Enhances credibility and brand trust in international markets.

Scalability

Easily add new countries as your business expands globally.

Eligibility for International Trademark Registration

Applicant must be a national, domiciled, or have a business in a member country of the Madrid Protocol.

A basic national or regional trademark application (or registration) must exist before applying for international protection.

Entities or individuals registered in India can apply through the Indian Trademark Office as the ‘Office of Origin.’

Documents Required for International Trademark Registration

1. Trademark registration/application details in India (basic mark).

2. Applicant’s name, address, and nationality.

3. Representation of the trademark (logo or word mark).

4. List of goods/services as per Nice Classification.

5. Power of Attorney (if filed by an agent).

6. Priority details (if any previous application exists).

Process of International Trademark Registration

1

Step 1: File a national trademark application in your home country (e.g., India).

2

Step 2: Submit an international application (Form MM2) through the Indian Trademark Office to WIPO.

3

Step 3: WIPO examines the application for compliance and issues an International Registration Number.

4

Step 4: WIPO forwards the application to each designated country’s trademark office.

5

Step 5: Each national office conducts its own examination and either grants or refuses protection.

6

Step 6: Once accepted, the trademark is protected in all approved countries for 10 years, renewable indefinitely.

Fees for International Trademark Registration

WIPO Fee

Basic fee + additional country-specific fees (depending on the number of designations).

Indian Trademark Office Fee

₹2,000 per international application (Form MM2).

Total cost depends on the number of countries selected and the type of mark (word, logo, or combined).

Validity and Renewal

International registration is valid for 10 years from the registration date.

Renewal can be done directly through WIPO for all designated countries together.

Failure to renew within the prescribed time may lead to loss of protection in all designated countries.

Protects your brand identity across multiple countries under a single filing.

Simplifies international enforcement and reduces administrative complexity.

Ideal for exporters, online businesses, and startups expanding abroad.

Ensures uniform protection standards under the Madrid Protocol framework.
